Moschella called the Propsect Zoning Board of Appeals meeting to order at 7 p.m. Members present Dominic Moschella, Martin Atkins, Harold Bernier; Alternates Donato Orsinin and Maryann Anderson. Chairman Moschella appointed Donato Orsini as a replacement for Betty Lou Holey and Maryann Anderson for Carl Graveline. Carl Graveline & Betty Lou Holley at 7:03 p.m. Previous appoinments of alternates rescinded.

NEW BUSINESS: Vincent LoRusso, requesting approval of location per Section 14-54 & 14-55 of State Status for dealing in or repeating motor vehicles at 72-74 Waterbury Road. Dominic Moschella pointed out approval was previously granted to previous owner John H. Barlow, Jr. and that according to State Statue no Public Hearing necessary. Martin Atkins would like a new Public Hearing especially due to issues brought up by a neighbor, Dr. DeBella. Carl Graveline and Harry Bernier opposed the holding a public hearing feelin git would be a duplicate of the previous public hearing held for Mr. John H. Barlow. MOTION made by Carl Graveline, seconded by Harold Bernier to accept the application for new ownership at 72-74 Waterbury Road for VW Properties. MOTION Unanimous

7:25 p.m. ZBA Application 12-2000 Thomas & Kimberly Fama seeking a 12-foot left side line variance. Notice published in Republican-American read into the minutes. Mr. Fama reviewed variance request, ZBA previously approved three foot front line variance, 12 foot variance requested is part of same addition for a farmers porch on front of house. Martin Atkins pointed out that 12 foot variance is basically for the porch roof extension. No one spoke in favor or opposition of variance request. Closed at 7:27 p.m.
NEW BUSINESS:
Herbet Corbett, property located at 125 Summit Road, seeking a 10 feet left side line and a 3 foot right side line variance for construction of a garage, property is pie shaped. Hardship configuration of lot, location of septic and well. MOTION made Betty Lou Holley, seconded by Harold Bernier to accept ZBA Application 14-2000 of Herbert Corbett and schedule a public hearing for November 28, 2000 @ 7:10 p.m. MOTION Unanimous

Chairman Moschella also read previous approval for John Barlow at same address. Motion made by CArl Graveline, seconded by HArold Bernier to approve ZBA Application 13-2000 of VW Properties approval of location per Section 14-54 & 14-55 of State Status for dealing in or repairing motor vehicles at 72-74 Waterbury Road, Prospect. Martin Atkins opposed. Motion Carried.
ZBA Application 11-2000 of Herwood & Cecelia Cochran: Motion made by Martin Atkins seconded by Carl Graveline to approve. Martin Atkins feels ZBA has made exceptions in th epast for smaller amounts, applicant looks like he made efforts to purchase abutting land, hardship basically the shape of the lot. Carl Graveline agreed that variance are minimal, neighbors concerns understood, need to position home within regulations of town. Dominic Moschella indicated would be forming two non-forming lots, basically subdiving property that is conforming. Zoning Board of Appeals job is to keep within regulations as much as possible. Betty Lou Holley agreed with Dominic Moschella. Carl Graveline also agreed, to an extent, but owner would be living in front. In Favor - Harold Bernier, Martin Atkins and Carl Graveline; Opposed Betty Lou Holley and Dominic Moschella. Motion Denied.
Application 12-2000 of Thomas Fama, property located at 93 Salem Road. MOTION made by Martin Atkins, seconded by Harold Bernier to grant a 12 foot side line variance in order to extend porch to go along with addition previsously approved. HArdship location of septic & well, non-conformity and configuration of lot. Martin Atkins pointed out that variance is consistent with prioe approval. Motion Unanimous.
Public Participation:
Ann Stein, Cook Road feels it is the Boards obligation to control building, Mr. Cochran's request was for a slight variance but it would be setting a precedent.
Martin Atkins indicated Towns Plan of Development being worked on witrh Planning and Zoning.
