Zoning Board of Appeals

July 24, 2001

The Regular meeting of the Prospect Zoning Board of Appeals was called to order by Chair Dominic N. Moschella at 7 P.M. Members present: Martin Atkins, Dominic Moschella, Harold Bernier, Carl Graveline and Alternate Donato Orsini. Absent Betty Lou Holley and Alternate George Havican. Chairman Moschella seated Alternate Donato Orsini for Betty Lou Holley.

Chairman Moschella asked for a moment of silence in memory of Mrs. Dorothy Harlow.

CORRESPONDENCE: Letter from Mayor Chatfield re: passing of Mrs. Harlow and closing of the Town Hall, July 25th, to allow employees to attend services 10 A.M. to 1 P.M. Motion made by M. Atkins, 2nd by C. Graveline to place correspondence on file. Motion Unanimous

Motion made by M. Atkins, 2nd by C. Graveline to pay the clerical bill. Motion Unanimous

Motion made by M. Atkins, 2nd by H. Bernier to approve minutes of June 26, 2001. C. Graveline abstained. Motion Unanimous

NEW BUSINESS:

Motion made by C. Graveline, 2nd by H. Bernier to add Glenn Cochran, 142 Summit Rd. and Herwood & Cecelia Cochran, 14 Cook Road to the agenda. Motion Unanimous

Michael Arisian & Stacey Gittings, 6 Rolling Ridge Court, requesting an eight-foot front line variance for a covered front porch. Motion made by H. Bernier, 2nd by M. Atkins to accept ZBA Application 6-2001 of Michael Arisian and Stacey Gittings, seeking an eight-foot front line variance and schedule the Public Hearing for August 28, 2001 @ 7:10 P.M. Motion Unanimous

David & Theresa Alves, 129 Cook Road, requesting a 15-foot right side line variance for construction of family room/dining room addition. Hardship being location of septic, leaching fields & non-conformity of lot. Motion made by C. Graveline, 2nd by H. Bernier to accept ZBA Application 7-2001 of David & Theresa Alves seeking a 15 foot right side line variance and schedule the Public Hearing for August 28, 2001 @ 7:20 P.M. Motion Unanimous

PUBLIC HEARING: ZBA Application 5-2001 of William & Schula Hobbs. Legal notice read into the minutes, published in the Republican-American on July 10th & July 19th. Stuart Glatt of Dependable Remodeling, agent for Mr. & Mrs. Hobbs, reviewed request. Seeking an 11 foot right side-line variance for a family room addition at 42 Straitsville Road, property lines were established prior to present ownership. Mr. Glatt reviewed the location of septic. Home is already non-conforming and addition will not exceed the non-conformity. No one spoke in favor or opposition. Public Hearing closed at 7:21 P.M.

NEW BUSINESS: (Continued)

Glenn Cochran, 142 Summit Road, requesting a 14-foot left side line variance for a family room addition. ½ acre lot is presently non-conforming. Motion made by M. Atkins, 2nd by C. Graveline to accept ZBA Application 8-2001 of Glenn Cochran and schedule the Public hearing for August 28, 2001 @ 7:30 P.M. William Donovan, Zoning Enforcement Officer, reviewed that when Wihbey Drive was constructed is required Mr. Cochran to have a 50 foot setback. Motion Unanimous

Herwood & Cecelia Cochran, 14 Cook Road, came before ZBA over six months ago. Application submitted and letter requesting subdivision of property at 14 Cook Road into two separate parcels. Variance request on the front parcel is for a reduction in the 135' building square for two sides to be reduced to 95 feet each. The variance is a 40-foot reduction on two sides of the 135-foot building square. Also allowing a reduction of the minimum lot size of 40,000 feet by 612 feet, for a remaining area of 39,388 square feet. The closest sideline is 35'. Rear lot would be 40,000 ft after taking 2,347 ft for the driveway - lot would have the 135 building square. Applicant indicated hardship is to subdivide the entire lot with minimum variance of zoning law. Motion made by D. Orsini, 2nd by M. Atkins to accept ZBA Application 9-2001 of Herwood & Cecelia Cochran and schedule Public Hearing for August 28, 2001 @ 7:40 P.M.

Action on Application: ZBA Application 5-2001 of William & Shula Hobbs seeking an 11-foot right sideline variance for a family room addition. Motion made by D. Orsini, 2nd by H. Bernier to approve the variance request. D. Moschella pointed out the house would not be more non-conforming as addition would be following existing non-conformity structure makes it difficult to put addition anywhere else on property. Motion Unanimous

C. Graveline left at 7:43 P.M.

PUBLIC PARTICIPATION: None

William Donovan spoke concerning Attorney's and Sydoriak issue from previous ZBA meeting, Attorney should be attending next ZBA meeting and will review final decision. Basically acknowledging that property is a non-conforming parcel.

D. Orsini left at 7:50 P.M.
