Zoning Board of Appeals

June 26, 2001

The Regular meeting of the Prospect Zoning Board of Appeals was called to order by Chair Dominic N. Moschella @ 7 P.M. Members present: Martin Atkins, Dominic Moschella, Harold Bernier and Alternate George Havican. Absent: Carl Graveline, Betty Lou Holley and Alternate Donato Orsini. Chairman Moschella seated Alternate George Havican for Betty Lou Holley.

CORRESPONDENCE: Planning & Zoning Minutes May 16 & June 6, 2001. Motion made by M. Atkins, 2nd by G. Havican to place on file. Motion Unanimous

Motion made by M. Atkins, 2nd by H. Bernier to pay the clerical bill. Motion Unanimous

Motion made by H. Bernier, 2nd by M. Atkins to approve the minutes of May 22, 2001. Motion Unanimous

OLD BUSINESS: None

NEW BUSINESS: Motion made by M. Atkins, 2nd by G. Havican to add application of William & Schula Hobbs, 42 Straitsville Road to the agenda. Motion Unanimous

Stuart J. Glatt of Dependable Remodeling LLC representing Mr. Hobbs. Applicant is seeking an 11' right side-line variance for an addition & to extend upper two dormers to existing non- conforming house. Motion made by M. Atkins, 2nd by H. Bernier to accept ZBA application 5-2001 of William & Schula Hobbs, 42 Straitsville Rd and schedule the Public Hearing for July 24, 2001 @ 7:10 P.M. Motion Unanimous.

PUBLIC HEARING: 7:10 P.M. Chairman Moschella read legal notice into the minutes which was published in the Republican-American June 13 & June 21, 2001. Edward & Bonnie Davis are seeking an 8-foot front line variance for construction of a family room, property located at 6 Orchard Drive. Applicant reviewed plans, house is a non-conforming structure. No questions from the members and no public comment. Public Hearing closed at 7:15 P.M. M. Atkins questioned location of septic & well. Applicant indicated that there is an underground oil tank that is going to be removed. Motion made by G. Havican, 2nd by H. Bernier to approve ZBA Application 4-2001 of Edward & Bonnie Davis an eight foot front line variance for construction of a family room hardship being geography of lot, location of septic & limitations due to well and existing design allows no other place to locate addition. Motion Unanimous
