The Regular meeting of the Prospect Zoning Board of Appeals was called to order by Chair Dominic N. Moschella at 7:04 P.M. Members present: Martin Atkins, Carl Graveline, Dominic Moschella, Betty Lou Holley @ 7:13 P.M. and George Havican. Absent: Harold Bernier and Alternate Donato Orsini.

Theodore & Sharon O'Reilly-Rozum, Jr., 15A Juggernaut Road. Applicant reviewed request - seeking a 14' right side line variance for a 1 story 22X24 garage addition. Motion made by M. Atkins, 2nd by C. Graveline to accept ZBA Application 11-2001, 15A Juggernaut Road, requesting a 14' right side line variance and schedule the Public Hearing for November 27, 2001 @ 7:10 P.M. Motion Unanimous
Diane Lendroth, 39 Peach Orchard Road. Letter received from applicant authorizing George and Maria Brown as her agent. Chair Moschella asked to be excused, as he is an abutting property owner. M. Atkins suggested future letter appointing agents be notarized, B. Holley agreed. Applicant reviewed request. Would like to build a new home on the property, variance request is for an eight foot left side line and an 8 foot right side line. Members reviewed map and configuration of lot. Motion made by M. Atkins 2nd by C. Graveline to accept ZBA Applicant 12-2001, 39 Peach Orchard Road, seeking an 8 foot right and left side line variance for the proposed building of a single family colonial home and schedule the Public Hearing for November 27, 2001 @ 7:20 P.M. B. Holley opposed to accepting the application. M. Atkins, C. Graveline, & G. Havican in favor. Motion carried. Applicant indicated that the purchase of the land is contingent on the variance.

M. Atkins reiterated the issue of having notarization from property owners when someone is acting as the agent. M. Atkins also requested that the town attorney review the issue of hardship with members.
