Prospect Zoning Board of Appeals

February 25, 2003

Chairman Dominic Moschella called the Zoning Board of Appeals meeting to order at 7:01 p.m. Other members present: Martin Atkins, Fred Harkins and Betty Lou Holley. Jeff Slapikas was absent. Alternates present: Jospeh Commendatore, who was seated for Jeff Slapikas.

Also Present: Bill Donovan, Clerk/Land Use Inspector

CORRESPONDENCE: a) Connecticut Bar Association announcement of upcoming seminar on Connecticut Land Use Law. Motion by M. Atkins, seconded by F. Harkins to place correspondence on file. Unanimous.

CLERICAL BILL: Motion by J. Commendatore, second by B. Holley to pay the clerical bill. Unanimous.

APPROVAL OF MINUTES: Motion made by M. Atkins, seconded by B. Holley to approve ZBA minutes of January 28, 2003 as amended. Four votes in favor with one abstention. Motion to approve carries.

NEW BUSINESS:

a) Peter Conroy (Conroy Development Corp), 145 Cheshire Road. Motion by J. Commendatore, seconded by M. Atkins to accept Application #02-2003 of Peter Conroy, 145 Cheshire Road and set a public hearing for Tuesday, March 25, 2003 at 7:10 p.m. Unanimous.

PUBLIC HEARINGS:

7:20 p.m. ZBA Application #01-2003 of Jeffrey and Susan Desiderio, 30 Heritage Drive for a 14-foot variance of Section 310 of the Zoning Regulations to construct an attached kitchen addition 36 feet from the rear property line. The public hearing closed at 7:30 p.m. Motion by F. Harkins, seconded by J. Commendatore to approve Application #01-2003 of Jeffrey and Susan Desiderio for a 14-foot rear property line variance. Unanimous. Reasons: location of house at the 50-foot rear property line setback as a result of wetlands and septic location on the front yard property.

OLD BUSINESS: Chairman Moschella related he attended a recent Planning & Zoning meeting to request that proposed changes to the zoning regulations consider a more exact definition of a utility building, shed and garage that clearly separates each from the other and that some considerations be given to restricting the bulk size of these structures. One suggestion mentioned at that meeting was to limit the size of the number of these structures that can be allowed on a residential structure (not to exceed 50% etc.) and place a limit on the number of these structres that can be allowed on a residential structure lot again by setting a maximum percentage in total square footage against the square footage of the primary structure (total square footage of accessory building cannot exceed 60% of the square footage of the primary structure, etc).
