Prospect Zoning Board of Appeals

January 28, 2003

Vice-Chairperson Betty Lou Holley called the Zoning Board of Appeals meeting to order at 7:02 p.m. Other members present: Martin Atkins, Fred Harkins and Jeff Slapikas. Alternates present: Joseph Commendatore, Carl Graveline and George Havican. Absent was Dominic Moschella. Vice Chairperson Holley seated Joe Commendatore for Dominic Moschella.
Also present: Bill Donovan, Clerk/Land Use Inspector.

CORRESPONDENCE: a.) Planning & Zoning Approved Minutes for January 8, 2003. b.) Letter from James Kulpa of Milone & MacBroom Engineering acknowledging the withdrawal of Application #33-2002, Halperin, 20 Peter Gilkey Road c.) The Segal Company, November 2002 newsletter. Motion by M. Atkins, seconded by C. Graveline to place correspondence on file. Unanimous.

CLERICAL BILL: Motion by M. Atkins, second by J. Slapikas to pay the clerical bill. Unanimous.

APPROVAL OF MINUTES: Motion made by J. Commendatore, seconded by M. Atkins to approve ZBA minutes of November 26, 2002 as presented. Three votes in favor with two abstentions. Motion to approve carries.

NEW BUSINESS:
a.) Jeffrey and Susan Desiderio, 30 Heritage Drive. Application for a variance of Section 300 of the Bulk Regulations to construct an attached kitchen addition 36 feet from the rear property line. The applicants are consequently seeking a 14-foot rear property line variance. Motion by J. Commendatore, seconded by F. Harkins to accept Application #01-2003 of Jeffrey and Susan Desiderio, 30 Heritage Drive and set a Public Hearing for February 25, 2003 at 7:10 p.m. Unanimous.
b.) 2003-2004 Proposed Budget. Board members reviewed the current year’s budget figures and after discussion agreed to carry the same individual item amounts over to the proposed 2003-2004 budget. Motion by J. Slapikas, seconded by M. Atkins to carry over all adopted 2002-2003 budget figures for the Zoning board of Appeals to the proposed 2003-2004 Town of Prospect Budget. Unanimous.

PUBLIC HEARINGS: None

OLD BUSINESS:
a.) ZBA Application # 32-2002 of William and Stacey Doerrer, 1 Buckley Lane, for a 15-foot side property line variance of Section 300 of the Zoning Regulations for a proposed 10’ x 24’ attached rear deck. The public hearing on this application was closed on November 26, 2002. J. Slapikas stated the house is on a non- conforming lot and is only 10 feet from the right side property line. The proposed deck would not be closer to the right side property line than the house. There was no further discussion. Motion by J. Slapikas, seconded by M. Atkins to approve Application #32-2002 of William and Stacy Doerrer, 1 Buckley Lane for a 15-foot right sideline variance to construct an attached rear deck. Three votes in favor, two abstentions. Motion to approve carries.
