APPROVED MINUTES
February 28, 2006

Chairman Martin Atkins called the meeting to order at 7:04 p.m.

Chairman Atkins seated George Havican for Matt Blinstrubas.

CORRRESPONDENCE: None

CLERICAL BILL: Motion by J. Slapikas seconded by M. Byrne to pay the clerical bill. Unanimous.

APPROVAL OF MINUTES: Motion by J. Slapikas, seconded by M. Byrne to approve the ZBA minutes of November 22, 2005 as presented. Three votes in favor with one abstention. Motion to approve carries.

NEW BUSINESS:
Mark J. Chevrier, 215 Cheshire Road. Application for setback variances for two separate structures. Mr. Chevrier stated he has a commercial garden center on Cheshire Road that has an existing trailer for an office and a separate green house. He wishes to replace the trailer with a permanent building and also replace the temporary greenhouse with a larger, permanent structure. Mr. Chevrier is requesting a 30-foot front line variance for a new building and a 15-foot rear property line variance for a new greenhouse. Motion by J. Slapikas, seconded by M. Byrne to accept Application 01-2006 of Mark Chevrier as described by the applicant and set a public hearing for Tuesday, March 28* 2006 at 7:10 p.m. Unanimous.

OLD BUSINESS:
Chairman Atkins mentioned properties in town that were granted variances and that currently have zoning violations. He referenced 176 Straitsville Road that has commercial trucks stored. The ZBA in 2002 had allowed a variance for an upper loft in a non-conforming structure here. Eight Old Schoolhouse Road has a canvas detached storage structure. The ZBA in 2004 granted a sideline variance for a garage addition. The Chairman also mentioned that a variance for a second story dormer was approved for a non-conforming house at 80 Straitsville Road. That house has since been demolished, however the town attorney stated the variance still goes with the property and a new structure, such as a garage, could utilize that variance. J. Slapikas pointed out that the structure would still need to comply with the zoning regulations that require a detached storage building to be located no closer to the street than the rear range line of the house and also a garage has to meet the same setback requirements as a conforming house. B. Donovan mentioned that legal briefs on the appeal of the denial of Joao and Maria Rodrigues on variances for a detached garage have not as yet been presented to the courts.

Lori DaSilva introduced herself as a new alternate board member. Lori will attend the next |ZBA meeting in March.
