APPROVED MINUTES
May 23,2006

Vice-Chairman Carl Graveline called the meeting to order at 7:14 p.m.

Other Members Present: Matthew Blinstrubas, George Havican (Alt), Lori DaSilva (Alt)

Members Absent: Chairman Martin Atkins, Jeffrey Slapikas, Marianne Byrne

Also Present: William Donovan, Clerk/Land Use Inspector

Vice-Chairman Graveline seated L. DaSilva for M. Byrne and G. Havican for J. Slapikas

CORRRESPONDENCE: None

CLERICAL BILL: Motion by M. Blinstrubas seconded by G. Havican to pay the clerical bil Unanimous.

APPROVAL OF MINUTES: Approval of the April 25, 2006 minutes was deferred to the next meetin: scheduled for June 27*.

NEW BUSINESS:
a. Dominic T. Laudate, 8 Morris Road. Application for a 20-foot front property line variance to place ai attached deck 30 feet from the front property line. Mr. Laudate explained his house was built prior t< zoning and is less than 50 feet to the front property line. He cannot place a deck in the front without beinj within the minimum front property line setback requirement. The lot is approximately V* acre in size am is less than the minimum one acre zoning requirement. Motion by M. Blinstrubas, seconded by L DaSilva to accept Application 05-2006 of Dominic Laudate as presented. Unanimous. A public hearing was scheduled for Tuesday, June 27th at 7:10 p.m.

b. Hans Reichardt, 474 Matthew Street. Application for two 25-foot side line variances for a proposed residential structure. Mr. Reichardt stated 474 Matthew Street is a remnant property which should have been included in a previous subdivision of his that was granted approval by Planning & Zoning approximately 30 years ago. The property is 50 feet wide and without variances no structure can be built. Motion by L. DaSilva, seconded by M. Blinstrubas to accept Application 06-2006 as presented. Unanimous. A public hearing was scheduled for June 27th at 7:20 p.m.

c. Counterpoint Communications, Inc., 37 Peach Orchard Road. Application for a detached 3,150 square foot garage in a residential zone that exceeds the maximum allowed 800 square foot size limitation. Roseann Scamardella represented the applicant. Ms. Scamardella stated Counterpoint Communications operates a broadcast station for the Hartford Catholic Archdiocese. They are a legal non-conforming business in a residential zone. There is no available storage for equipment or vehicles and the archdiocese has an opportunity to acquire a steel garage large enough to satisfy their storage needs. B. Donovan stated the board would also need to consider if this application would be an expansion of a non-conforming use. After some discussion, it was agreed Counterpoint would go forward with their variance request. Motion by G. Havican, seconded by L. DaSilva to accept Application 07-2006 of Counterpoint Communications for a 2,350 square foot variance of the maximum 800 square foot size limitation for a detached garage in a residential zone. Unanimous. A public hearing was scheduled for June 27th at 7:30 p.m.

OLD BUSINESS: None

PUBLIC HEARINGS:
a. 8:15 p.m. Application 04-2006: John R. Joyce, 12 Overlook Court for a 120 square foot variance of the 600 square foot maximum area allowed for a detached garage in a residential zone. Chairman Graveline read into the record the "Notice of Public Hearings" for this application as it appeared in the Republican American on May 1 1 and 19, 2006. Mr. Joyce was not in attendance. B. Donovan stated he had spoken with board member Jeffrey Slapikas who informed Bill that Mr. Joyce was withdrawing his application. Planning & Zoning recently approved an amendment to the regulations increasing the maximum size of a detached garage from 600 square feet to 800 square feet. As Mr. Joyce was seeking a variance that would have permitted him to build a 720 square foot detached garage, the new amendment now allows Mr. Joyce to go forward with his plans without the need of a variance. There was no public attendance or comment and Vice-Chairman Graveline considered Application 04-2006 withdrawn.
