Clerical Bill: Motion by J. Slapikas, seconded by M. Byrne to pay the clerical bill. Unanimous.
Approval of Minutes: Motion by M. Byrne, seconded by J. Slapikas to approve the August 29, 2006 minutes with amendments. Three votes in favor with two abstentions. Motion to approve carries. Motion by C. Graveline, seconded by G. Havican to approve the September 5, 2006 minutes with amendments. Three votes in favor with two abstentions. Motion to approve carries.
New Business:
a. ToddBrewer, 29 Maple Drive. Application for a 13 foot side yard variance for a sunroom. Mr. Brewer is representing the property owners, Claire and Bruce Hadzega. Mr. Brewer stated the Hadzegas are seeking to construct a three-season room on their existing deck that is 15 feet to the right property line. They are asking for a 13 foot side yard variance to allow the sunroom with overhang to be within 12 feet of the property line. Motion by J. Slapikas, seconded by C. Graveline to accept Application 14-2006 of Todd Brewer for a 13 foot side yard variance. Unanimous. A public hearing was scheduled for October 24,2006 at 7:10 p.m.
b. Gary & Lynn Beard, 131 Matthew Street. Application for a 15 foot 2 inch side line variance for an attached garage. Chairman Atkins noted that Mr. Beard had recently applied for a 21 Vz foot side line variance for a detached garaged that was denied by the board (Application 10-2006). He stated under the statues the board is not required to hear any application for the same or substantially the same variance for a period of six months after a decision is made by the board. Mr. Beard stated he has since reduced the proposed size of the garage and consequent variance request from the original 21 ¥2 feet to 15 feet 2 inches. He stated the lot is non-conforming in area and width and the house is non-conforming in that it is less than 25 feet to the left sideline. After discussion, the board agreed to hear this new application on its own merits. Motion by M. Byrne, seconded by J. Slapikas to accept Application 15-2006 of Gary & Lynn Beard for a 15' 2" side line variance for an attached garage. Unanimous. A public hearing was scheduled for October 24,2006 at 7:20 p.m. Chairman Atkins called for a motion to add BillieJo Racine, 61 Waterbury Road to the agenda under "New Business". Motion by C. Graveline, seconded by G. Havican to add BillieJo Racine to the agenda. Unanimous.
c. BillieJo Racine, 61 Waterbwy Road. Application to place a second detached sign on a Business District zoned property. Ms. Racine stated she is representing the "Hotchkiss House" historical museum and gift shop owned by the Town of Prospect. They are seeking to place a second detached sign on the property specifically for advertising the gift shop and artisans' showcase located in the barn behind the house museum. She stated the two signs combined would not exceed the maximum 24 square feet allowed for one detached sign. Motion by M Byrne, seconded by C. Graveline to accept Application 16-2006 of BillieJo Racine for a seconc detached sign at 61 Waterbury Road and waive all fees. Unanimous. A public hearing was scheduled for October 24,2006 at 7:30 p.m.

Public Participation: None. Chairman Atkins discussed the need to get notice out to the public to obtain the necessary zoning and building permits prior to beginning a construction project. He comments were based on the recent applications before the board concerning variances for existing structures.
