Chairman Martin Atkins called the meeting to order at 7:05 p.m.

Chairman Atkins seated G. Havican for J. Slapikas and L. DaSilva for M. Blinstrubas

Public Hearings:
a. 7:08 p.m. Application 01-2007: Donald Reilfy, 110 Waterfnay Road for a 15 foot front property line variance on Oak Lane for a detached garage, (continued from January 30th). Chairman Atkins read into the record the "Notice of Public Hearings" for this continued public hearing as it appeared in the Republican American on January 26, 2007. Chairman Atkins stated he will recuse himself from taking part in mis public hearing due to a business relationship he has with Mr. Reilry. Vice-chairman Carl Graveline assumed the Chairman's position. Mr. Reilly stated he is seeking a 15 foot front property line variance on Oak Lane for a new detached garage thai would replace the existing garage on his property. The parcel is a corner lot with .66 acres. There is a 50-fooi zoning setback requirement on both Waterbury Road and Oak Lane. Mr. Reilly stated there are several examples in Prospect of commercial buildings that are less than 50 feet to the property line. His existing garage is non-conforming in that it is located closer than 50 feet to his property line abutting Waterbury Road. The new garage would be compliance with the 50-foot Waterbury Road setback and would be 35 feet to the Oak Lane property line. Mr. Reilly stated the new garage would not be closer to Oak Lane than the existing house. He stated the proposed garage is a better looking structure than the existing garage and should enhance the overall architectural aesthetics of the property. M. Byrne questioned the location of the garage as shown on the property noting the north arrow designation is incorrect. M. Byrne confirmed from Mr. Reilly there are slopes on the southern portion of the property. Mr. Reilly stated the garage would be 40 wide by 75 feet long and 16 feet high. It is a 3-bay garage. G. Havican asked that because the side of the proposed garage falls on the 25 foot setback line, he would want an 'as-built' foundation plan to confirm the structure's location satisfies all setbacks and does not require additional variances. There were no comments from the public and no further comments from the board. The public hearing closed at 7:19 p.m.

Action on applications following close of public hearing:
Application 01-2007: Donald Reilly, 110 Waterbury Road for a 15 foot front property line variance on Oak Lane for a detached garage. Motion by G. Havican, seconded by L. DaSilva to approve Application 01-2007 as presented. Discussion: L. DaSilva is in favor of granting the variance as the new garage will not be closer to Oak Lane than the existing house. M. Byrne is also in favor of granting the variance because of the two 50-foot front property line setbacks. C. Graveline stated because of the non-conforming small size of the property, the nonconfortning locations of the existing structures and additional corner lot street setback requirements he is in favor of granting the variance. C. Graveline called for a vote. In favor: Unanimous, with the condition an "as-built foundation plan" be completed and submitted to the Land Use Inspector to confirm the structure's location complies with the variance allowance and other property line setbacks.

Martin Atkins resumed the chairman's position.

Adjournment: Motion by M. Byrne seconded by G. Havican to adjourn at 7:30 p.m. Unanimous.
