Approval of Minutes: Motion by C. Graveline, seconded by M. Atkins to approve the minutes of the February 27, 2007 meeting. Two votes in favor with one abstention. Motion to approve carries.
Clerical Bill: Motion by C. Graveline, seconded by G. Havican to pay the clerical bill.
New Business:
A. Elmer Oakes, 15 Union City Road. Application for a 7, 859 S.F. aread variance to reduce the size of his conforming lot of 41, 591S.F. to a non-conforming lot with 32,141 S.F. Mr. Oakes stated he desires to sell off a portion of his property to his abutting neighbor at 11 Union City Road that is on the corner of Union City Road and Carmel Drive. That lot currently has approximately 27,000 S.F. The 9,450 S.F. land addition would reduce that area non-conformity of this lot. Mr. Oakes would extend the common property line between the two lots to his rear boundary, eliminating that section of his property that borders Carmel Drive. C. Graveline asked if both properties are the same zone. Mr. Oakes stated they are both residential (RA-1). Mr. Oakes stated he has a letter from the Chesprocott Health District saying his lot would still have adewuate area for a code-complying septic system after the proposed property transfer. Motion by C. Graveline, seconded by G. Havican to accept Application 03-2007 of Elmer Oakes as presented. Mr. Oakes' irregular shaped lot and reducing the area non conformity of #11 Union City Road were the stated reasons for the requested variance. Unanimous. A public hearing was scheduled for Tuesday, April 24, 2007 at 7:10 pm.
Public Hearings:
A. 7:10 p.m. Application 02-2007: George Nagy, 25 Lombard Drive for a 4 foot variance to place a 14' x 22' pre-built detached shed 16 feet from the right side line. Chairman Atkins read into the record the "Notice of Public Hearings" on this application as it appeared in the Republican American on March 16 & 23, 2007. Mr. Nagy submitted certified receipts of mailings to adjacent neighbors. He stated he wants to place a detached shed behind his existing garage. The septic is in the back yeard and he prefers not to have the shed located on the left side of the property. The shed is 14' x 22' in size and would be place on crushed stone. He has received approval from Chesprocott Health District for this proposed location. Chairman Atkins asked if other locations on the right side of the property would require variances as well. Mr. Nagy stated other than a possible conflict with the septic system there may be other locations available. There is a 10 foot easement given to the Lombards on the left side of his property. There is an open lot behind his property. The shed would be located approximately 5 feet from the back line of the house and 169 feet from the rear property line. Chairman Atkins read into the record a letter questioning a buried oil tank and if all options for this shed's location have been explored including placing the structure at the rear of the property. Mr. Nagy stated his septic is located in the rear and that Petro Fuel removed the buried oil tank where the shed would be placed. Chairman Atkins asked for comments from the public. Bill Donovan questioned when the certified letter were mailed. Mr. Nagy stated March 19th. Chairman Atkins requested and board members concurred a Special Meeting will be held on Tuesday, April 3, 2007 at 7 pm to continue this public hearing. A fall back date of MOnday, April 2, 2007 was also proposed in the event a minimum of 4 board members can not attend the Tuesday meeting. George Nagy asked for additional comment and stated the health department does not want any disturbance over or near the septic system. He also stated the right rear location s presented by Mr. Lombard is unacceptable because it is downhill of the septic. Chairman Atkins acknowledged that board has asked for size reductions in the past. The public hearing adjourned at 7:50 p.m.
