Public Hearings:
7:10 p.m. Application 04-2007: Robert Morin, 101 Waterbury Road for a 20 foot and 15 foot side line variance for a proposed detached storage building to place the structure 5 feet and 10 feet to abutting side lines. Chairman Atkins read into the record the "Notice of Public Hearing" as it appeared in the Republican American on May 10 & 18, 2007. Elaine Morin represented the applicant. Mrs. Morin presented certificates of mailings to all adjoining property owners. She stated they are seeking to construct a storage building to house their customer's equipment in a protected, secure environment. Chairman Atkins asked Mrs. Morin to explain their hardship relative to this variance. She stated this is the only lcoation where such a building could go for work purposes. They have had robberies of equipment in the past and they need to get customer equipment (snow blowers, tractors, lawn mowers, leaf blowers, etc.) inside a secure location. Also getting this equipment inside the building would help clean up the surrounding area. She stated placing this building on the right side of the property where there is open space does not comport with the needs of the business (R.P.M.) The mechanics work off the back of the office building and need ready access to the customer's equipment for servicing. Where they are proposing the building is adjacent to the mechanic's work area. Also, the septic system is located on the right side of the property and they can not place the building over the septic. Chairman Atkins asked what the size of the proposed building is and why was this size selected. Mrs. Morin stated teh building is 60' x 35'. They need this size because they hacve a large inventory of equipment on site that can expand to 100-150 pieces during the busy season. J. Slapikas asked if this new building will house all of the equipment now stored outdoors and also in the future. He asked if the building will be on concrete or directly on the ground. Mrs. Morin stated it will be either concrete or asphalt and their intention is to clean up the site and store as much of the equipment as possible inside the building. C. Graveline asked if the propsed building could be attached to the existing building. Mrs. Morin stated that would eliminate the area where the mechanics now work. She would be concerned with proper ventilation next to the main building and the need to allow the mechanics direct access to the equipment. Chairman Atkins asked about the two existing pods on the building. Mrs. Morin stated they also store additional parts and equipment. Chairman Atkins stated he would like to see the general clutter of parts and equipment on the property either stored inside or removed altogether. Chairman Atkins asked Mrs. Morin if she was aware of other existing commercial building located as close to a property line as this proposed structure. Chairman Atkins noted there is no one from the public in attendance for this public hearing. Consequently there are no comments from the public. Robert Morin appeared at 7:35 p.m. He stated the building's large size is needed to avoid having to keep shuffling equipment around to get to a particular item. There will be a large door in front and a small door in the rear. The building is proposed as a 24 foot, one story structure with an internal loft for additional storage. Attaching the building to the existing commercial building would interfere with the mechanic's work area. Aldo, this is a proposed storage building and has a different function than the main commercial building where customers enter and business activities are taking place. G. Havican asked that a foundation "as-built" should be completed to ensure the building is placed where it shows on the application. Mr. Morin noted several other commercial buildings in the area that are close to property lines. There were no further comments and the public hearing eas closed at 7:42 p.m.
Action on applications: Motion by C. Graveline, seconded by J. Slapikas to approve Application 04-2007 of Robert Morin, 101 Waterbury Road for a 20 foot by 15 foor side line variance for a proposed detached storage building. Discussion: J. Slapikas stated he is normally not in favor of granting two variances for any one application, however, he does see how granting these two variances would result in the property getting a much needed clean up of outside materials, provide a significant improvement in environmental safe guards and help deter theft of equipment. He also stated he personally would like to see a poured concrete slab under the structure to contain spillage of fluids. L. DaSilva agreed improving the site is important to this property and the surrounding area. Other options discussed for the structure's location were not feasible. G. Havican is in favor and afreed having the equipment locked inside the building will deter theft of equipment. C. Graveline holds with this location being the best possible spot for a storage building and also favors cement flooring. Chairman Atkins stated other commercial buildings in the area are as close to their property lines as this structure will be. He does not want to see this building becoming used for a new or separate business. He understands the R.P.M. business is growing and the structure benefits the needs of this business without causing an expansion of a new, separate business. Chairman Atkins called for a vote. In favor: Unanimous.
