Town Council

June 17, 2003

The regular council meeting was called to order @ 7 P.M. by Chair Cynthia L. Gibbons. Members present: Robert Doyon, Patricia Geary, Delores Franks, Cynthia Gibbons, Domenic Jannetty, Douglas Merriman, Edward Miller and Dominick Mirabelle @ 7:08 P.M. Absent Theresa Graveline

MAYOR'S REPORT: Asked council to add to the agenda re-appointment of auditor. Motion made by E. Miller, 2nd by P. Geary. Unanimous

Motion made by D. Merriman, 2nd by D. Franks to re-appoint Michael Battista as Auditor. Motion Unanimous

Mayor requested a special meeting to be held Tuesday, June 24th @ 7:15 P.M. for Year-end transfers, tax refunds and union negotiations. Motion by P. Geary, 2nd by D. Merriman

Also recommended canceling July 15th and August 5th Regular Council meetings for the summer. Motion by D. Merriman, 2nd by R. Doyon. P. Geary opposed. Motion carried.

Mayor referred to park ordinance urged council to adopt, if amendments are necessary they can be done in the future.

Revenue sheet reviewed. Recommended 30.00 Mill Rate. Tax Collection based on 98% collection rate. State Grants on revenue sheet reviewed. Motion by D. Merriman, 2nd by R. Doyon to set the mill rate @ 30.00. Motion Unanimous.

CHAIR REPORT: Park Ordinance - Bill Sereduck and Mark Mikulski Board of Recreation members present. Gene McCarthy, Asst. Director of Public Works would like to see bicycling & trail bikes discontinued, danger to walkers, also suggested the need for supervision morning to night. Bike rack was suggested in the parking lot. Lengthy discussion re: permits for non-residents, usage needs to be determined/defined. Various suggestions made for the attorney to re-draft including Page 2 #5: Change Mayor to Athletic Director, after discussion title changed to Program Director. C. Gibbons & D. Jannetty opposed to change. D. Jannetty indicated the intent was to have permits to use park and the issue of preventing damage. Feels mayor should have final decision as various organizations may want to use parks. Feels strongly that Mayor is ultimately responsible. Bill Sereduck indicated there may be a potential conflict if Mayor has final say. Feels fees need to be thought out more. G. McCarthy feels could be determined by Board of Rec. D. Merriman feels permits or organizations/teams only, over regulating. Reporter indicated that intent needs to be made clearer. D. Franks - Need to by equitable & consistent/potential conflict, safety issue - Potential violence an issue also. Atty. Casagrande suggested new draft for review and set Public Hearing. C. Gibbons polled council concerning permits for everybody/individuals - P. Geary - No, D. Mirabelle - No, D. Jannetty - No; C. Gibbons - No; R. Doyon - No; E. Miller - No; D. Merriman - No. Unanimous

Motion made by D. Merriman, 2nd by P. Geary to approve minutes of Special Council Meeting. D. Jannetty abstained. Motion carried.

CORRESPONDENCE: Letter from Robert Hiscox, Chair of Planning & Zoning questioned Zoning Ordinance. Suggested to invite Mr. Hiscox and Gil Graveline to next council meeting.

Motion made by R. Doyon, 2nd by E Miller to Hold a Public Hearing on the Zoning Ordinance July 1st @ 7 P.M. and advise P&Z. Motion Unanimous

ADDITION CORRESPONDENCE: Request from Tax Collector to waive Tax Bills less than $2. For the October 1, 2002 Grand List. Motion made by D. Franks 2nd by R. Doyon Unanimous. Inspectors Reports; Police Report; Letter from Atty. Vance Re: Santos seeking legal action against the Town of Prospect for the disparate treatment of him, asked that he be contacted within next 10 business days so that discussion can take place avoiding litigation. Motion made by D. Merriman 2nd by D. Jannetty to place correspondence on file.

Motion by P. Geary, 2nd by D. Jannetty to add to agenda for next council meeting sewer ordinance.

Atty. Casagrande - Park Ordinance - Some Towns restrict # of People - Non residents pay 1 price, residents pay a lower price
