Approved Minutes July 6, 2004

The Town Council meeting was called to order by Robert Doyon, Chair at 6:56 p.m.

Members Present:Joseph Commendatore, Robert Doyon, Theresa Graveline, Frederick Harkins, Douglas Merriman, Edward Miller, Dominick Mirabelle, Dominic Moschella and Patricia Geary (arrived at 7:04 p.m.)

There were neither guests nor public participation.

Motion made by D. Merriman to approve the June 15, 2004 minutes. T. Graveline seconded the motion. Unanimous.

Motion made by D. Merriman to approve the June 29, 2004 special meeting minutes. F. Harkins seconded the motion. T. Graveline and J. Commendatore abstain. Motion carries.

Letter from the Prospect Land Trust regarding reimbursement of real estate taxes paid on December 31, 2003 on the October 1, 2002 grand list. (P. Geary arrived at 7:04 p.m.)
Copy of letter from R. Hiscox, Planning and Zoning Commission to Mr. Donovan, Prospect Land Use Inspector, thanking him for the many extra hours worked associated with the development and revision of Prospect land use documents.

There was a general discussion regarding the Tax Emempt ordinance in reference to the Prospect's Land Trust's request fo a refund of taxes paid.

Motion made by T. Graveline to forward the Prospect Land Trust's request to Diane Lauber, Tax Collector, and for her to reply in writing to the Prospect Land Trust and forward a copy of her reply to the Town Council. Motion seconded by D. Merriman. Unanimous.

Motion made by T. Graveline to place correspondence on file. Motion seconded by P. Geary. Unanimous

E. Miller questioned the status of Mr. Thomas Santos' request for a refund in real estate taxes for property located at 47-49 Waterbury Road. Has the dollar amount of the refund he is asking for been resolved? E. Miller questioned if the amount Mr. Santos is asking for is correct or were the Tax Collector's figures correct.

D. Merriman requested that the Chair follow-up on the status of Mr. Santos' tax obligation and report to the Council. R. Doyon stated that he would folow-up and report back.

Motion made by J. Commendatore to designate the Prospect Planning & Zoning Commission as the Town's Acquifer Protection Agency. Motion seconded by T. Graveline. Motion discussed.

T. Graveline questioned if the Council needs to report back to the Planning and Zoning Commission as to the approval of the ordinance as indicated within the Acquifer Protection Implementation Schedule.

D. Moschella indicated the Planning and Zoning would be notified of the approval.

T. Graveline feels that the Council should follow-up with the Planning and Zoning Commission within six months according to the State Land Use Regulations time line to see where things stand.

There was not further discussion. Motion unanimous.

F. Harkins stated that he would report to the Council regarding the status of the Settlement Agreement and Release between the Town of Prospect and Mr. McCarthy, Assistant Public Works Director.

Motion made by J. Commendatore to adjourn at 7:15 p.m. Motion seconded by D. Moschella. Unanimous.
