Approved Minutes

September 19, 2006

The Town Council meeting was called to order by Joseph Commendatore, Chair at 7:01 p.m.

Members Present: Joseph Commendatore, Theresa Graveline, Frederick Harkins, Dominick Mirabelle, Dominic Moschella, Robert Doyon, and Douglas Merriman

Members Absent: Patricia Geary and Roger Kergaravat

Mayor’s Report:
No Action was taken on Intermunicipal Sewer Agreement between Town of Prospect & City of Waterbury

Mayor Chatfield was not in attendance.

Motion made by D. Moschella to add to the agenda an Executive Session to discuss ongoing negotiations regarding the Intermunicipal Sewer Agreement and to discuss the Schweizer Farm property. Motion seconded by R. Doyon.

Motion unanimous.

Chair’s Report

The Council received a letter from the Democratic Town Committee for an appointment; The Council also received a letter from Jim Brundage concerning the possible sale of his property to the Town in the future.

Guests: none

Public Participation:

Diane Lauber, Tax Collector discussed property owned by City of Waterbury which is part of the golf course. She found in past files Re: sewer fees that there is a state statute that exempts property owned by a municipality, if it’s used for public purposes, from paying property taxes.

Approval of Minutes:

Motion made by T. Graveline to approve the minutes of the September 5th, 2006 meeting with corrections. Motion seconded by F. Harkins. F. Harkins, D. Moschella & D. Merriman abstained.

Motion carried.

Motion made by F. Harkins to approve the minutes of the September 8th, 2006 Special Meeting with corrections. Motion seconded by T. Graveline. D. Mirabelle stated that he did not attend the September 8th Special Meeting because he was not notified of it. R. Kergaravat was also not notified of the September 8th, 2006 meeting. D. Moschella, J. Commendatore and D. Mirabelle abstained.

Motion carried.

Correspondence:


Tax refunds dated September 2006; Letter from Jim Brundage regarding possible purchase of his property; Resolution of the Prospect Town Council & CCM Energy Purchasing Program; Summary of Savings from CL&P for 36 Center Street; August-Zoning Inspector’s Report; July & August-Building Inspector’s Report; August-Electrical Inspector’s Report; August-Heating Inspector’s Report; Letter submitted by Diane Lauber Re: Tax Exemption for municipal property; Municipal Animal Control District Agreement;

Motion made by D. Merriman to place correspondence on file. Motion seconded by T. Graveline.

General discussion on sewer agreement. D. Mirabelle asked if the sewers can be bonded. The Council discussed that Prospect taxpayers money will not go to the City of Waterbury.

Motion unanimous.

New Business:
Transfers- None
Refunds- Motion made by F. Harkins to approve the refunds for September 2006. Motion seconded by D. Moschella.

Appointments – Letter from Democratic Town Committee for Appointment of Kathleen M. Greene of 13 Spruce Drive to the Library Board.

Motion made by D. Merriman to approve the appointment of Kathleen M. Greene of 13 Spruce Drive to the Library Board. Motion seconded by T. Graveline.

Motion unanimous.

Motion made by T. Graveline to refer the letter from Jim Brundage regarding the town possibly purchasing his property at 3 Center Street in the future, to the Land Use Sub-Committee. Motion seconded by R. Doyon.

Motion unanimous.

Motion made by D. Merriman to approve the Resolution for the CCM Energy Purchasing Program Motion seconded by D. Moschella. The Council discussed the 10-15% savings on generation rates. D. Mirabelle feels that the Council should make this decision and should be notified if any changes are made. T. Graveline asked if there is any time constraint on making a motion on this resolution. D. Mirabelle opposed.

Motion carried.

Motion made by D. Merriman to set a public hearing on Sept. 27th 2006 at 7:00 p.m. at the Prospect Town Hall, 36 Center Street, for the purpose of considering authorizing the construction of a sanitary sewage system by Toll Brothers, Inc. on property owned by R.M.K. Associates, LLC to be connected to the City of Waterbury public sewage system. Motion seconded by T. Graveline. The Council discussed time constraints on this agreement. T. Graveline requested publication in the Saturday morning newspaper concerning the tentative public hearing scheduled for Wednesday, September 27th as long as the Board of Alderman in Waterbury comes to an agreement on Monday Sept. 25th.

Motion unanimous.

Motion made by T. Graveline to set a Special Meeting immediately following the Public Hearing on September 27th, 2006 to take action on the Intermunicipal Agreement. Motion seconded by D. Mirabelle.

Motion unanimous.

Old Business:


Sub-committees Reports- none

The Animal Control agreement will be discussed at the next meeting.

D. Mirabelle stated that he will not be in attendance at the Sept 27th Public Hearing or Special Meeting and he is in favor of the agreement as long as no Prospect taxpayer money is going to the City of Waterbury.

Motion made by D. Merriman to go into Executive Session at 7:40 p.m. to discuss ongoing negotiations regarding the Intermunicipal Sewer Agreement and to discuss the Schweizer Farm property. Motion seconded by R. Doyon.

Motion unanimous.

Motion made by R. Doyon to come out of Executive Session at 8:20 p.m. Motion seconded by F. Harkins. No votes or motions were taken during Executive Session.

Motion unanimous.

Motion made by D. Merriman to authorize Theresa Graveline to secure an appraisal of the Schweizer Property, 15 acres on Roaring Brook Road. Motion seconded by R. Doyon.

Motion unanimous.

Motion made by R. Doyon to adjourn the meeting at 8:26 p.m. Motion seconded by D. Moschella.
