March 6, 2007

The Town Council meeting was called to order by Joseph Commendatore, Chairman at 7:01 p.m.

Members Present: Joseph Commendatore, Robert Doyon, Patricia Geary, Theresa Graveline, Douglas Merriman, Dominick Mirabelle and Dominic Moschella.

Members Absent: Frederick Harkins and Roger Kergaravat.

Mayor’s Report: (Mayor Chatfield was not in attendance)
• Executive Session to discuss Real Estate at 76 Mountain Road

Motion made by T. Graveline to amend the agenda to hold the Executive Session at the end of the meeting. Motion seconded by D. Moschella.

Motion unanimous.

• Capital Plan Update- Tabled to the next meetings agenda

Chair’s Report:
Chairman Commendatore wanted to remind the Council about Saturday’s Special Meeting at 9:30 a.m. in the lower level conference room of the Prospect Town Hall.

Approval of February 20, 2007 Minutes:
Motion made by D. Moschella to approve the February 20, 2007 minutes as amended. Motion seconded by R. Doyon. P. Geary and D. Mirabelle abstained.

Motion carried.

Motion made by R. Doyon to place the correspondence on file. Motion seconded by P. Geary.

T. Graveline asked for clarification on the Police Patrol Report. P. Geary requested that Resident State Trooper Nelson come to a Council meeting to discuss this.

Motion unanimous.

Motion made by D. Merriman to approve the recommendations for appointments for Charles F. Mallon, 16 Bayberry Dr. as a regular member of the Emergency Management Advisory Committee, Jeffrey A. LaMontagne, 3 Saunders Lane as a regular member of the Emergency Management Advisory Committee, Larry Fitzgerald, 10 Robinmark Rd. as an alternate member of the Emergency Management Advisory Committee, and Lawrence Rifkin, 21 Holley Lane to finish the remaining term on the Economic Development Commission, vacated by Donoto Orsino.

Motion seconded by T. Graveline.

Old Business:
Sub-committees Reports-
T. Graveline submitted to the Council a memo clarifying the responsibilities of the Prospect Town Council Land Use Subcommittee, Prospect Open Space Purchase Advisory Committee, and the Open Space Planning Subcommittee of the Conservation Commission. T. Graveline discussed this memo in detail. She also discussed an Open Space Plan. D. Merriman feels that the Council should review this memo and make sure that the steps and responsibilities for each Committee are accurate.

  • Executive Session to discuss Real Estate at 76 Mountain Road

    Motion made by D. Merriman to go into Executive Session at 7:22 p.m. regarding a Real Estate Transaction at 76 Mountain Road. Motion seconded by R. Doyon.

    Motion unanimous.

    D. Merriman excused himself from the meeting at 7:40 p.m.

    Motion made by T. Graveline to come out of Executive Session at 7:47 p.m. regarding a Real Estate Transaction at 76 Mountain Road. Motion seconded by R. Doyon. No votes or motions were made during Executive Session.

    Motion unanimous.

    Motion made by R. Doyon to allow T. Graveline to contact the owners of the property and try to negotiate a purchase for the Town of Prospect. Motion seconded by D. Moschella.

    Motion unanimous.

    Old Business: (continued)
    T. Graveline mentioned properties that are currently becoming available and properties that will become available in the future. The Town needs to make the best use of the properties designated as open space.

    The Council would like to be notified when an application is received for a new development which would include open space. Council would also like to be made aware of any applications currently before the Planning & Zoning Commission that would include open space so that they can get involved in the process.

    Motion made by P. Geary to have Chairman Commendatore write a letter to the Chairman of the Planning & Zoning Commission requesting that the Town Council be advised of current and new applications for development before the Commission. Motion seconded by D. Mirabelle.

    The Council wants to be part of the design of the open space parcels.

    Motion unanimous.

    Ordinance Subcommittee-
    D. Moschella mentioned new information on a State Law he has received.
