Chairman Joseph F. Commendatore called the meeting to order at 7:00 p.m. The meeting was taped.
Members Present: Robert Doyon, Patricia Geary, Theresa Graveline, Frederick Harkins, Roger Kergaravat, Douglas Merriman, Dominick Mirabelle, Joseph Commendatore and Stanley Pilat.
Members Absent: none
Mayor’s Report: Mayor Chatfield was not in attendance.
Chair’s Report:
J. Commendatore would like the Land Use Committee to contact the South Central Regional Water Authority to see if there is any potential sale of land in Prospect either now or in the near future. He would like the Town to be pro-active regarding this issue. T. Graveline stated that at a meeting with Diane Tompkins she discussed land the water company is looking to sell. The Mayor has been in contact with them as well. T. Graveline stated she will get an update on it.

Approval of September 4, 2007 Meeting Minutes:
Motion made by T. Graveline to approve the minutes of the September 4, 2007 meeting. Motion seconded by R. Kergaravat. R. Doyon abstained.
Motion carried.
Correspondence:
Letter from WPCA Re: Replacement of William Stankowicz,; Resignation of Robert Kiernan-Emergency Management Advisory Council; Proposed Draft Ordinance Re: Police Protection; Tax Collector’s Report-July; Zoning Inspector’s Report-August; Prospect Police Patrol Report-August; Building Inspector’s Report-August; Tax Refunds-Sept. 18, 2007.
Motion made by R. Doyon to place the correspondence on file. Motion seconded by T. Graveline. Motion unanimous.
New Business:
T. Graveline requested the totals of the tax refunds that the Council has had to approve in the past; refunding the tax payers because of confusion on where they resided and what Town they should be taxed in.
Motion unanimous.
Resignations – Action-
Motion made by D. Merriman to accept the resignation of Robert Kiernan from the Emergency Management Advisory Council. Motion seconded by R. Kergaravat.

Appointments – Action-
The Council discussed the WPCA letter regarding the replacement of Mr. Stankowicz. A letter will be sent to the Republican Town Committee encouraging them to act on this letter and inform the Council on their decision.
Old Business:
• Sub-committees Reports –
• S. Pilat stated the Ordinance Subcommittee met twice since the last Town Council meeting. He referred to a draft ordinance on Police Protection at Construction Sites that was handed out to each Council member. This ordinance would give more authority to the Resident State Trooper requiring developers to hire police officers to be on site. T. Graveline stated that this is done only when the developer is willing to do so. The Council discussed clarifying the wording in the draft ordinance.
Motion made by R. Doyon to send the Draft Ordinance for Police Protection at Construction Site, to the Town Attorney. Motion seconded by P. Geary.
Motion unanimous.
D. Mirabelle asked about the line being painted on Royal Crest Drive. D. Merriman and R. Kergaravat stated they mentioned this to the Mayor and they are waiting for a response.
D. Merriman stated Saturday there was a re-dedication of the monument on the Green. He would like a letter sent to Mr. Gomez from the Council thanking him for coordinating the event and working so hard putting everything together.
D. Mirabelle stated that on Oct. 13th the Prospect Lions Club is putting on a benefit dinner for Phyllis Scarpati to honor and celebrate her life. She was a Town Employee and the wife of the Building Inspector. The donations will go towards some of the medical expenses incurred.
